Law management help: Law theories
Task 1It is viewed that Utilitarianism provides more flexibility, whereas Deontologists might safeguard morality with strengths and perform duties seriously. If I were a poor uneducated homeless person on a life raft in the middle of the Pacific Ocean then I would rather be with a deontological brain surgeon. It is quite secure and safe to be with the deontological brain surgeon rather than with utilitarian brain surgeon.
It is very clear that the utilitarian theory signifies the importance of elements such as human dignity, minority protection, respect, individual rights and moral theory which may be required (McCloskey, 2006). In general, Utilitarian finds out the rightness of the action by evaluating its consequences. The Utilitarian would give so many reasons not to cheat on the exam like cheating is not the right way to get pass in the exam and cheating would destroy the career of the children’s. On the other side, deontologists are concerned about the right things and they concerned about it. According to deontologists, good and right are two distinct things and they are very much concern about the right. Deontologist does not have so much regulations and this provides them the fair sum of freedom. Deontologists are the people who decide to choose constraints and choose what is accurate by viewing at the description of act itself. Deontologists are concerned on the right thing so they would not allow the children’s to cheat on the exam (Nussbaum, 2001). Because according to them cheating is the path which is not right for the children’s and ruins the career of the children. At last it can be said that the Deontology theory is motivated by religious thinking comprising restrictions on cheating, murdering, lying, promise breaking and torturing. If the police knocked on the door and asked about the friend that he was hiding in the cellar or not then being a deontologist, I would say about the right thing to the police that my friend is in the cellar, and you should arrest him. Being a Deontologist I would give favor to things which are right and motivated by the religious thinking comprising restrictions on cheating, lying, murdering and torturing (Putnam, 2003).
Task 2It is very clear that the tradition shows the seven sins as deadly or dangerous. They are soul- deadening opposed to soul enlivening virtue praised in beatitudes. Pride is selfishness and self assertion, Avarice is referred as selfish reach to keep and grab for oneself, Mercy is reach to share and give with others, Envy shows another happiness and communicates another happiness, Wrath wills destruction and harm and refuses to peacemaking and harm and safeguards destruction, Sloth rejects to use the will against the good, Lust categorizes the soul and desiring each attractive body and Gluttony wishes to spend the inordinate quantity of the worldly goods.
In general, virtue is referred as the positive quality or trait and valued as the basis of excellent moral being and principle. It is very clear that virtue may not be taught. It is viewed that there is no any teacher or student of virtue. Numerous virtuous people have children who are non virtuous, in spite of many attempts to educate the virtue. But on the other side, sin is the violation and deviation of the eternal divine law or standard. Sin considered as the inescapable and unfortunate impact of the human finitude (Gintis, Bowles & Boyd, 2005).
Sin is the deviation and violation of the eternal divine standard or law. The word sin might consider to the condition of having such violation (Kidder, 2003). Sin referred as the unfortunate and inescapable effect of the human finitude. The individual does not run away his self through asceticism and diversion. In recent time, sin is referred as soul deadening opposed to the soul enlivening virtue praised in the beatitudes.
Task 3
Cultural relatively refers to the idea generally explained in the cultural anthropology. It indicates what is wrong or right and evolved the idea which is significant to the culture.Heinz should have done this because his wife condition was very critical and there was the one drug that the doctors said could save her. The man who made the drug wanted to make a profit out of the drug (Jonathan, 2001). It is viewed from the case that Heinz told the man who created the drug that his wife was dying and told him to sell the medicine cheaper and the rest amount he will pay later. But the man who made the drug said that he had made the drug and wants profit out of it. At last, when all efforts made by Heinz get failed then he decided to break the store and stole the medicine to save his wife.
According to the case, there is no any element of self interest for Heinz. Heinz wanted to save the life of his wife and there was no any personal benefit that the Heinz would have after stealing of the medicine from the store of the man who had made the drug. Heinz was fulfilling his responsibility towards its family and family members (Nussbaum, 2001).
The attached article is all about the availability of the cancer drug in the region of Australia. The senior advisor of the Cancer Council said that the structure was implemented to produce the affordable medicines which are free from economic, equity and ethical issues. The system was formed so that everyone would have access to medicines not only the rich ones. This article has altered my response because it indicates that there are people who think about the people, society and their needs. Heinz felt very bad when there was no one to support him emotionally and financially. Producing of affordable medicines free from any kind of ethical and equity issues would motivate the people who are in need. This type of the initiative would motivate the people in the society to never lose the hope.
Task 4It is very clear that virtue may not be taught. It is viewed that there is no any teacher or student of virtue. Numerous virtuous people have children who are non virtuous, in spite of many attempts to educate the virtue. In simple words, virtue may not be taught. But on the others side, virtue survives in various people who were not born virtuous and not educated the knowledge which makes the actions virtuous.
According to the case, both brother and sister had decided that it would be fun and entertaining if they tried to make love (Putnam, 2003). In general, making love is good because it gives relaxation and fun to the individuals but making love among brother and sister is not acceptable by the people of the society. As per me, making love between sister and brother is not ethical and acceptable in the society. There should be some respect for the relations exist in the society.
It was not OK for them to make love because being a brother and sister they are not permitted to do all such things. In general, making love can happen among lovers and husband and wife. In general making love leads the couple to feel even closer to each other.
Task 5
In general, using of the IVF technology and the opening of a designer baby clinic are considered as the misuse of the technology. It is viewed that the technology behind the designing babies has the possibility to change the human race (B B C health news, 2000). Designing of a baby introduces so many possibilities and ethical dilemmas. In, fact pregnancies must be conceived through use of reproductive technologies and has come under the subject of the public discussion.
This is the beginning of the slippery slope because quick advances in the scientific information of human genome, enhancing capability to change and modify genes and designing of the baby could well become probable in the future. Moreover, the forming technology of the generic alteration begins with the entire group of possibilities that can result in designer babies.
There are some issues while using the IVF technology and Designer baby clinic such as pregnancies should be conceived with the help of reproductive technology and comes under the subject of public discussion. Designer babies used to explain how the genetic technology may be implemented to decide the color, eye, sex and other features of the child.
The situation of the Nadya Suleman is different to the designer babies as identified in the article. In fact, Suleman stated her vision of having the big family as the nightmare. After giving born to eight babies and fertility treatment now she hates her babies. Nadya Suleman was able to give birth to eight babies with the help of IVF technology and this technology was implemented for couples who are suffered with the infertility and genetically inherited disorder. On the other side, designer babies used to explain how the genetic technology may be used to decide the sex, hair and eye color and other features of the child. In fact, the technology behind the designer babies has the probability to change the human being race.
During the process of the screening, the existence of the genetic disorder such as Cystic Fibrosis and Down’s syndrome may be ascertained with the help of Karyotype Study. Once the embryo of desired sex has located and it can be implanted in the female uterus with the help of cervix. This may viewed as unfair and AHEC thinks that the selection of the sex could result in the expression of the social and sexual prejudice. This kind of genetic disorder can be minimized by avoiding technology such as IVF and designer babies (Fitzpatrick, 2001).
