Law assignment on: Implication of Various theories
OPPOSING the argument: Individual privacy is most important consideration in an organization:
Consequentiality theory:
- Egoism: Egoism can be of two types, one is positive and other one is negative. Both have different meaning and results for the organization point of view. If the positive thing is done by an individual or the team then it will reflect in the performance enhancement of the organization and team both. But on the other hand if the negative egoism is followed by an individual or a team then it will have a negative impact on the performance of team and individual both (Whitmen, 2004).
Here in the case of individual privacy, if it is taken as a positive aspect for organization point of view, then it will be an effective step by the organization. So organization should take it as a positive egoism, and employees understand that they should consider all the methods taken by the employers is for some betterment in the organization which will ultimately lead to the prevention of various mischievous activities in the organization.
- Utilitarianism: The utilitarianism theory relates the individual performance and action in terms of the outcome or the consequences of the action. So if the organization takes a step to avoid the individual privacy at work place then it may reflect in the employee’s performance, they may be dissatisfied with this aspect of avoiding the individual privacy at work place (Nye, 2002).According to the Utilitarian theory anything that is done is done for the betterment of all, so if the organization is taking necessary steps to prevent employee privacy than it is doing because it wants that organization productivity is not affected anyhow.Intallation of camera, medical check ups and taking consent from the employs show that the employers are concerned about the employees rights and so they have informed them all the action which would be taken by them before only. SO there is nothing wrong according to Utilitarian theory if individual privacy is not given the most important consideration
Non- Consequentiality theory:
- Kant theory: Kant theory says that the action taken may lead to good or bad but the it depends on us to decide what to do and how to do to achieve a good will (Whitman, 2004).So according to this theory if the employers feel that that camera nod medical check ups are an important part of organization safety then it should take those steps because it will it will be for the goodwill of all. If data theft takes place in the organization it will spoil the name of the company, and thus ultimately affect the employess in the organization.
- Virtual Ethics is different from all other ethics as it focuses on the moral thinking behind the deeds that one is doing. It is not based on philosophy but on the fact that we should ultimately do those things which is good ethically and morally. According to this theory if an organsitaion is taking steps to prevent employee privacy it is also taking employees consent and informed them beforehand so tare is nothing unethical or immoral in this.
Theories SUPPORTING the argument
Egoism: Here Negative egoism has a greater impact when employees think that their privacy is hindered .They think theta the steps taken by the employees like camera nod medical check ups are not against the ethical policy and is in fact against their privacy policy.thy do not accept these and take it in wrong way which ultimately affects the organization growth and may lead to conflict
Utilitarianism: This theory relates the consequences and actions. According to this putting if camera may affect the performance of employees as they may be feel that are monitored each and every moment ,and this will ultimately lead to bad performance as they may also have the feeling that organization do not have trust on their employess, this may also lead to conflict in workplace.
Non- Consequentiality theory:
Kant theory: according to Kant theory, it ultimately depends on us how we are taking the different theories, so employees think that privacy is not being considered important in the raga niztion, and then they will not do anything which is productive for the company. it depends on employees how they Rae taking the necessary steps taken by the organization .Medical health checks is against the individual privacy as it affect the individual privacy, it depend on particular employee if he wants the test to be done or not.
Virtual theory: Virtual theory says that hindering employee’s privacy is unethical and immoral because every individual has right to privacy which should not be hindered. Checking employees mails and always keeping an eye ion them is not against any individual privacy. There should be trust factor in the organization where employers think that anything done by the employees in not wrong and in fact they should try to create such environment which will be beneficial for both, instead of using unethical practices of using cameras and CCTV in the organization
